These Terms of Use ("Terms") govern your access to and use of any website, map, application, dataset, datasheet, catalog, or service (collectively, the "Services") owned or operated by Pickatrail, Inc., a Nevada corporation ("Pickatrail," "the Company," "we," or "our"). By accessing or using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must discontinue use of the Services.

We may update these Terms at any time. Your continued use of the Services constitutes acceptance of any updated Terms.

If any other document conflicts with these Terms, these Terms control.

1. Use of the Services

The Services are provided solely for your personal, non-commercial use. You agree not to:

• violate any applicable law;
• infringe any intellectual property or privacy rights;
• interfere with or disrupt the Services;
• attempt to gain unauthorized access to the Services or related systems;
• use automated tools (including robots, scrapers, or spiders) to access the Services;
• use the Services to develop, train, or improve any competing product or service;
• copy, modify, distribute, or create derivative works from the Services or any Content.

We may suspend or terminate your access to the Services at any time and for any reason.

2. Ownership and Use of Content

Definitions

"Content" means all information, data, maps, illustrations, designs, articles, images, photographs, videos, audio, software, features, and other materials made available through the Services.

Pickatrail Content

All Content and all intellectual property rights in the Services are owned by Pickatrail or its licensors. Except for the limited license below, no rights are granted to you.

Subject to your compliance with these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Services and Content for personal, non-commercial purposes.

You may not copy, modify, reverse engineer, distribute, sublicense, or commercially exploit any Content or portion of the Services.

All rights not expressly granted are reserved.

Content Disclaimer

Content is provided for informational purposes only and may contain errors or omissions. The maps and data provided are for informational purposes only and are not intended for navigation or safety-critical use. We make no representations regarding accuracy, completeness, reliability, or applicability. You assume all risk for any reliance on the Content.

Feedback

Any feedback or suggestions you provide may be used by Pickatrail without restriction or compensation.

3. User-Submitted Geodata

"Geodata" means cartographic or geospatial information. "Contribute" means intentionally submitting Geodata to Pickatrail.

By contributing Geodata, you grant Pickatrail a perpetual, worldwide, royalty-free, irrevocable, non-exclusive license to reproduce, prepare derivative works of, display, perform, sublicense, and distribute the Geodata and derivative works.

You represent that you have all rights necessary to grant this license and that you waive any moral rights to the fullest extent permitted by law.

Pickatrail may modify, refuse, or remove any contributed Geodata at its discretion.

4. Trademark & Copyright Restrictions

All trademarks, logos, and service marks ("Trademarks") displayed on the Services are the property of Pickatrail or third parties. Nothing in the Services grants any license to use any Trademark.

You may not use Trademarks in any manner, including in meta tags, hidden text, or domain names.

All materials on the Services are copyrighted unless stated otherwise. Pickatrail will enforce its intellectual property rights to the fullest extent permitted by law.

5. Warranties and Disclaimers

The Services are provided free of charge and "as is".

Pickatrail makes no warranties, express or implied, including warranties of accuracy, reliability, availability, merchantability, fitness for a particular purpose, or non-infringement.

We do not guarantee that the Services will be uninterrupted, error-free, secure, or free of harmful components.

Pickatrail is not responsible for any reliance on the Content or any injury, loss, or damage resulting from your use of the Services, or for any third-party content, links, or services.

Because the Services are provided free of charge, you agree that the limitations and exclusions of liability in these Terms are reasonable and form an essential basis of the agreement between you and Pickatrail.

Some jurisdictions do not allow certain warranty exclusions. To the extent such laws apply to you, some exclusions may not apply.

6. Indemnification & Limitation of Liability

You agree to indemnify and hold harmless Pickatrail and its officers, directors, employees, and agents from any claims arising out of your use of the Services or your violation of these Terms.

To the maximum extent permitted by law, Pickatrail is not liable for any indirect, incidental, consequential, special, or punitive damages, including lost profits, lost data, or computer failure, even if advised of the possibility of such damages.

In no event shall Pickatrail's total liability exceed the greater of (a) the amount you paid to use the Services (which is $0), or (b) $99.

Some jurisdictions do not allow certain limitations of liability. To the extent such laws apply, some limitations may not apply, and Pickatrail's liability will be limited to the fullest extent permitted by law.

7. Electronic Communications

By using the Services, you consent to receive communications from us electronically. Notices are deemed delivered when sent to the email address you provide (if applicable). You are responsible for keeping your contact information current.

8. International Use

The Services are operated from the United States. If you access the Services from outside the U.S., you:

• consent to the transfer and processing of your information in the U.S.;
• agree not to access the Services from embargoed countries or if you appear on U.S. sanctions lists;
• agree to comply with all local laws; and
• acknowledge that the Services may not be appropriate or legal in your jurisdiction.

You access the Services from outside the U.S. at your own risk.

9. No Waiver

Failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other rights.

10. Governing Law

These Terms are governed by the laws of the State of Nevada, without regard to conflict-of-law principles. You agree to the exclusive jurisdiction of courts located in Clark County, Nevada.

The United Nations Convention on Contracts for the International Sale of Goods does not apply.

11. Miscellaneous

If any provision of these Terms is found unenforceable, the remaining provisions remain in full force. Section headings are for convenience only.

You may not assign these Terms. Pickatrail may assign them without restriction.

These Terms constitute the entire agreement between you and Pickatrail regarding the Services.
